Terms of Service

DJ on AIR (the “Service”) is operated by MOWA LABS LLC, a Florida limited liability company (“we”, “us”). By creating an account or using the Service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority where you live, to create an account.

DJ on AIR is a marketplace that connects people hosting an event (“Hosts”) with DJs and singers (“Residents”) who perform live over the internet. We provide the booking, chat, payment and live-audio tools. We are not a party to the agreement between a Host and a Resident, and we do not employ Residents.

• Provide accurate information and keep your password secure.
• You are responsible for all activity under your account.
• One person per account. Do not impersonate others or share your login.
• Tell us promptly if you suspect unauthorized access.

Resident profiles are reviewed before they go live, and we may approve, reject, suspend or remove a profile at our discretion. Residents control their own pricing and availability.

Residents confirm that they own or have the rights to the music, mixes, images and other content they upload or perform, and that they are responsible for any licences required to perform it. Residents are independent contractors, not employees or agents of DJ on AIR.

When you request a booking, your card is authorized, not charged. The hold is captured when the Resident’s set ends. If the booking is declined or cancelled before then, the hold is released.

Payments are processed by Stripe. A platform fee is deducted from the booking amount and the remainder is paid to the Resident through Stripe Connect. By using payments you also agree to Stripe’s terms.

Prices are set by Residents. You are responsible for any taxes that apply to you.

Hosts and Residents should cancel as early as possible. Where a booking is cancelled before the set starts, the card hold is released unless the booking page states otherwise.

If something goes wrong during a set, raise a dispute from your booking page. We aim to review disputes within 24 hours and may release, refund or withhold funds based on what we find. Our decision on a dispute is final within the Service, without limiting any rights you have under law.

You agree not to:

• harass, threaten or abuse other users, including in chat and live shoutouts;
• post unlawful, hateful, sexually explicit or infringing content;
• take bookings or payments off the platform to avoid fees;
• record, rebroadcast or publicly stream a Resident’s set without their permission;
• scrape, probe, overload or attempt to break into the Service;
• use the Service for fraud, including payments with cards you do not own.

We may remove content and suspend or close accounts that break these rules.

You keep ownership of the content you submit (profile text, photos, demo mixes, reviews, messages). You grant DJ on AIR a non-exclusive, worldwide licence to host, display and transmit that content as needed to run and promote the Service. You are responsible for what you post.

Live audio depends on internet connections, devices and venue equipment that we do not control. We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation, or that a set will reach any particular audio quality or latency.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you break these terms or put other users or the Service at risk. Provisions that by nature should survive termination (including payment obligations, content licences, disclaimers and liability limits) will survive.

The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not guarantee the quality, safety or legality of any Resident’s performance.

To the extent permitted by law, DJ on AIR is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid through the Service in the 12 months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

We may update these terms from time to time. We will post the new version here and update the date at the top. If a change is material we will notify you in the app or by email. Continuing to use the Service after a change means you accept it.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction, except where the law of your home country gives you the right to bring a claim elsewhere.
